Most of the cases detailed below involve abuse that has occurred since 2000 and was reported to law enforcement quickly -- within just a few years of occurrence. The girls were members of the parish where Aguirre worked, in the Santiago municipality of Quilicura [Santiago Province].
It is worth noting that the factors that have caused significant disclosure elsewhere of secret church files and abusive priests’ names – widespread litigation by victims, investigations of church entities by prosecutors, and inquiries by government commissions – have not so far occurred in Chile. In September 2002, the day after a mother accused Aguirre of abusing her two daughters, Aguirre again was allowed by Santiago archdiocesan leaders to flee Chile for Honduras. After the priest's arrest, more victims came forward.
This list, then, is a fraction of the total number of accused clerics who would be known if Chile's church leaders were required to report to law enforcement, if its legal system allowed victims more time to bring criminal and civil charges, or if dioceses and religious orders were investigated by prosecutors or state commissions. In Australia, which has half as many Catholics as Chile and a comparable number of active priests and brothers (around 5,000), a recently concluded government inquiry counted child sex abuse allegations against more than 1,100 male clergy. Her confessors included Archbishop Cox, who was suspected at the time of sexual abuse.
The lack of external pressure allows Catholic church leaders in Chile to act with impunity. In June 2003, a Chilean court sentenced Aguirre to 12 years in prison for the crime of “abuso deshonesto” against nine girls and statutory rape against a tenth victim.
They openly reinstate, for instance, priests who have faced multiple allegations of abuse. Juan Carlos González Deacon Luis Rubio González Rev. (He reportedly had raped and impregnated at least one girl when she was age 13.) Aguirre thus became the first Chilean priest to be convicted of sexually abusing children.
Chile’s senior churchman, Santiago archbishop Cardinal Ricardo Ezzati, announced in December 2016 that Cristián Precht Bañados had fulfilled his canonical sentence of five years’ suspension from ministry. Although the criminal trial considered only crimes committed by the priest between 19, the judge ruled that the Church had had prior notice of Aguirre's criminal tendencies and so was jointly responsible for reparations to the victims.A church investigation had uncovered 20 victims of Precht, ranging from age 15 to 35. The Church was guilty of failing to act with care to prevent future crimes, the judge said.Yet Precht is now allowed again to say Mass publicly, Ezzati said; he has regained “his fundamental exercise of the rights he has as a presbyter." Ezzati's lenience toward Precht is reflected in the Chilean bishops' latest abuse policy: Care and Hope: Guidelines of the Episcopal Conference of Chile to Deal with the Cases of Sexual Abuse of Minors. It instead gives the bishop the option of a range of penalties (see paragraph 60, page 42). Aguirre was released from prison in November 2012, 24 months early, sparking concern among residents of the Santo Domingo district where he decided to locate.Promulgated in 2015, the 80-page document pledges pastoral care of victims and a commitment to protecting children. It also contains no promise by the bishops to inform law enforcement of abuse; instead, it reminds victims and their relatives that it is their responsibility to report (see paragraphs 53-56 on page 40). He died in November 2013 at age 56 from complications of muscular myotonic dystrophy.Finally, it omits any recognition of the church’s role in making reparations to the victims. He disclosed the abuse in 1981 to Marist brother Mariano Varona, who stated in a 2018 interview that he informed his provincial at the time.
